İtiraz edilen sandık kurullarının İstanbul Büyükşehir Belediye Başkanlığı seçimi yanında diğer üç seçim türü için de görev yaptığı belirtilen dilekçede, bu nedenle sadece büyükşehir belediye başkanlığı seçiminde yolsuzluk yapıldığı iddialarının kabul edilemeyeceği savunuldu.
YSK’nin yerleşik içtihatlarına göre, “tam kanunsuzluk hali”nin, yasaya açıkça aykırılığın tespiti halinde ortaya çıktığı aktarılan dilekçede, şu ifadeler kullanıldı:
“Sandık kurullarının teşkiline ilişkin yapılan itirazın sayın kurul tarafından kabul edilmesi sonucunda, aynı sandık kurullarının diğer seçim türlerinde de görev alması nedeniyle bu durumun İstanbul’daki tüm seçimleri ilgilendirdiği kurulun malumudur. Bu nedenlerle hakkında somut bulgu ve delile rastlanılan sandık kurulu başkan ve memur üyelerinin varlığı halinde tam kanunsuzluk hali oluşmaktadır. Bu nedenle 31 Mart’ta İstanbul’da yapılan seçimlerin tümünün iptali ve yenilenmesi gerekmektedir.”
